Namens de auteurs van visuele kunstwerken van wie zij de auteursrechten beheert, verzet SOFAM zich formeel tegen het gebruik van hun werken, door systemen van artificiële intelligentie (AI) in het kader van de uitzondering voor tekst- en datamining voorzien in artikel 4 van de Europese richtlijn 2019/790, omgezet in de Belgisch wetgeving in artikel XI 190, 20° van het Wetboek van economisch recht.
Door bezwaar te maken tegen reproducties van hun werken binnen dit kader (opt out), brengt SOFAM deze exploitatiehandelingen terug binnen de reikwijdte van het exclusieve recht.
Elke operator die voor tekst- en dataminingdoeleinden werken wil gebruiken van deze auteurs, moet bijgevolg een aanvraag indienen bij SOFAM.

SOFAM opposes the use of visual artworks by systems of artificial intelligence (AI) within the framework of the exception for text and data mining

On behalf of the authors of visual artworks, for whom she exercises the relevant copyrights, SOFAM formally opposes the use of their works by systems of artificial intelligence (AI) within the framework of the exception for text and data mining, provided in Article 4 of the European Directive 2019/790, that was transposed into Belgian legislation in article XI 190 20° of the Code of Economic Law.
By opposing reproductions of their works within this framework (opt out), SOFAM redirects these acts of exploitation back within the scope of the exclusive rights.
Every operator that wishes to use works of these authors for text and datamining purposes, is therefore required to submit a request to SOFAM.
